Introduction and Scope of Booking Conditions
The following booking conditions form the basis of your contract with Learn to Paint with Dermot Cavanagh, or Dermot Cavanagh, T/A Rhoneview Studio (“we”, “us”, “our”) for painting holidays and breaks in Croatia, Italy, Slovenia, Venice, and Ireland. Please read these conditions carefully, as they set out the rights and obligations of both parties.
These booking conditions apply to all painting holiday and breaks arrangements you book with us and which we agree to provide, perform, or make available as part of our contract with you. For the purposes of these conditions, references to “holiday”, “break”, “booking”, “contract”, “package”, “tour”, or “arrangements” shall be taken to mean the relevant holiday arrangements booked with us.
In these booking conditions, the terms “you” and “your” refer to all persons named on the booking (including anyone who may be added or substituted at a later date).
1. Making Your Booking
The individual who makes the booking (“the party leader” where more than one or two persons are booking together) accepts responsibility for ensuring that all payments due in respect of the booking are made in full and on time. Where air travel or overseas travel is required for participation in a painting holiday or break, it is your responsibility to ensure that you are in possession of a valid passport and, where applicable, the necessary visa(s). You are also required to obtain comprehensive travel insurance to cover any circumstances that may prevent you from travelling to, or participating in, the holiday or break.
2. Your Contract
A binding contract between you and Learn to Paint with Dermot Cavanagh T/A Rhoneview Studio will come into effect once we have received your deposit payment. This contract, and any dispute, claim, or other matter arising out of or in connection with it, shall be governed exclusively by the laws of Northern Ireland. Both parties agree to submit to the exclusive jurisdiction of the courts of Northern Ireland in respect of any such dispute, claim, or matter.
3. Payment
To confirm your booking, a deposit is required as follows:
Venice (4-Night Painting Holiday/Break): £300 per person for a double or twin room, or £400 per person for single occupancy of a double room.
Croatia, Italy, and Slovenia (7-Night Painting Holiday): £400 per person for a double or twin room, or £600 per person for single occupancy of a double room.
Ireland (Package Breaks): £199 or £259 per person, depending on the package selected.
If your booking is made within 6 weeks of the holiday start date, full payment is required at the time of booking.
For all overseas painting holidays, the balance of the total cost must be received no later than 6 weeks prior to departure. Failure to make payment in full and on time will be treated as a cancellation of your booking, in which case we are entitled to retain all deposits and any payments already made or due at that time. If we delay cancellation because you have assured us payment will be made, but it is not received, cancellation charges as outlined in Clause 5 will apply, calculated from the date we reasonably treat your booking as cancelled.
4. The Cost of Your Holiday
We reserve the right to amend or correct errors in advertised prices at any time prior to the confirmation of your booking. In such cases, you will be informed of the applicable price at the time of booking. Once a booking has been confirmed, the price payable will not be subject to change. However, we retain the right to increase or decrease the prices of any unsold holidays or breaks at any time.
- Cancellation by You
If you or any member of your party needs to cancel a confirmed booking, the party member who made the booking must notify us in writing without delay. As costs are incurred from the time of booking, the following cancellation charges will apply:
- 84 days or more before departure: Deposit will be refunded less any costs already incurred in relation to the booking.
- 83–61 days before departure: Deposit is forfeited.
- 60–43 days before departure: 50% of the total holiday cost is payable.
- 42 days or fewer before departure: 100% of the total holiday cost is payable.
All cancellation charges are calculated per person cancelling.
Depending on the reason for cancellation, you may be able to recover these charges (less any applicable policy excess) under the terms of your own travel insurance. Any claims must be made directly to the insurance provider.
If you or a member of your party is unable to travel, we will make every effort to assist by offering alternatives. Where possible, we will:
- Reschedule the booking to another of our painting holidays, breaks, or course dates, with minimal disruption and cost; or
- Allow the booking to be transferred to another person introduced by you, provided we are notified no later than 6 weeks prior to departure and the transferee meets all the requirements of these booking conditions.
Please note that airline carriers typically charge fees for name changes on flight bookings, and these costs must be borne by the transferee.
6. Changes and Cancellation by Us
Our holidays are planned many months in advance, and while we make every effort to avoid alterations, we must reserve the right to make changes to, correct errors in, or cancel published details, including those on our website, information sheets, and promotional materials, both before and after bookings have been confirmed.
We will not cancel your confirmed painting holiday booking less than 6 weeks prior to departure, except in the following circumstances:
where you have failed to comply with the requirements of these booking conditions, including payment obligations.
where cancellation is necessary due to “force majeure” as defined in Clause 7; or
where the minimum number of participants required to operate the holiday (if applicable) has not been met.
If it becomes necessary to make a significant change to your holiday or to cancel your booking, we will notify you as soon as possible. Where time permits prior to departure, you will be offered the choice of one of the following options:
a) accepting the revised arrangements;
b) transfer your booking to an alternative painting holiday or break of a comparable standard, if available; or
c) if no reasonable alternative arrangements can be agreed, we will endeavour to provide you with a refund of monies paid to us.
7. Force Majeure.
Force Majeure Except where otherwise expressly stated in these booking conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any damage or loss as a result of “force majeure”. In these Booking Conditions, “force majeure” means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.
8. Passports and Visas
It is your responsibility or the responsibility of the party member who made the booking to ensure that you or all members of the booking party are in possession of valid passports, visas, and any other required travel or health documentation prior to departure. We strongly recommend that applications for Visas be made in a reasonable time, and that applications passports be made at least six weeks before travel, as current processing times for new passports are approximately four weeks.
All costs associated with obtaining passports, visas, or other required documentation must be borne by you. We accept no liability if you or any member of your party is refused entry to any mode of transport or into any country due to failure to present the correct travel documentation.
If you or any member of your party is not a British or Irish citizen, or does not hold a British or Irish passport, it is your responsibility to check the specific passport and visa requirements with the relevant Embassy or Consulate of the destination country.
Should our company incur any fines, penalties, surcharges, or other financial liabilities as a result of your failure (or that of any party member) to obtain or present the necessary travel documentation, you will be required to fully reimburse us.
9. Delay
We regret that we are unable to provide assistance in the event of delays at your point of departure or return. Any assistance, including refreshments, may be provided by the airline or transport operator concerned.
We cannot accept liability for any delay, whether caused by the airline, transport provider, or any other circumstances beyond our control.
